Four months ago Songwriter Leon Zimmerman whom Vallee named as co-author sued for an accounting of $80,000 profits.
In Chicago last week Judge Philip L. Sullivan made a decision which favored neither Claimant McKay nor Claimant Zimmerman. Judge Sullivan decided that the song originated with Jesse Brown, a Chicago lawyer, who argued that he wrote it ten years ago while an undergraduate orchestra leader at Northwestern University. The court ordered Vallee to give Lawyer Brown an accounting of his "Vagabond" royalties.
